TAMPA ESTATE PLANNING LAWYER

Tampa Estate Planning Lawyer Kevin A. Fuller represents clients seeking to secure their wealth and ensure its proper distribution upon the client’s death.

WHAT IS AN ESTATE PLAN?

Every person who owns real estate or has other assets or minor children should develop an estate plan to fit their specific needs. Tampa Estate Planning Lawyer Kevin A. Fuller will create an estate plan designed specifically for each client.

A properly drafted estate plan will distribute your assets to your beneficiaries. It also reduces taxes, provides for minor children, and ensures your wishes are satisfied. The estate plan usually includes the following documents:

a) A Trust or Will;
b) A Living Will;
c) A Designation Of Healthcare Surrogate;
d) A Power Of Attorney (POA);
e) A Do Not Resuscitate (DNR).

WHAT IS THE DIFFERENCE BETWEEN A TRUST AND A WILL

There are many types of trusts. The most common are revocable and irrevocable trusts. A Trust will distribute your assets and avoid the need for probate, but it must be funded correctly. A Will distributes your assets to your designated beneficiaries but requires probate.

WHAT IS THE DIFFERENCE BETWEEN A LIVING WILL AND DESIGNATION OF HEALTHCARE SURROGATE

A Living Will is a document that appoints a surrogate to speak on your behalf regarding medical decisions should you be unable to do so. If you are in a vegetative state, terminally ill, or in the end-stage of an illness, the Living Will is activated.

A Designation Of HealthCare Surrogate is similar to a Living Will, but it does not require the elements of a Living Will to exist before becoming effective.

WHAT IS A POWER OF ATTORNEY

A Power Of Attorney (POA) gives your designated Agent the legal authority to handle your financial affairs. It is important that you fully trust your Agent because you are giving him or her full authority to act on your behalf

WHAT IS A DNR

A Do Not Resuscitate (DNR) is a directive to your physicians not to resuscitate or revive you should your heart and respiratory system stop functioning.
