WHAT CAN I DO TO PREPARE FOR A DIVORCE IN FLORIDA?

Preparing for divorce in Florida is an important step in protecting yourself. A divorce can be a long, stressful, and life-altering event. If divorce is your only option, there are a few things you can do to make your divorce and transition to single life smoother. To ensure and secure your future, you should consider the following:

  1. Gather all of your financial documents (bank statements, credit card statements, retirement plan statements, tax returns for the previous 3 years, W-2 for the previous 3 years, corporate/partnership tax returns, note and mortgage on your house, investment account statements, 5 previous pay stubs, etc.);
  2. Obtain a credit card in your name;
  3. Open a new bank account in your name at a different bank;
  4. Withdraw half of the proceeds in your joint bank account and deposit them in your new bank account (make sure all outstanding checks or debit charges have cleared before withdrawing funds. Do not move funds that belong to your spouse. Do not jeopardize marital assets, such as your house);
  5. Gather all estate planning documents (life insurance policy, wills, trusts, power of attorney, healthcare directives, etc.);
  6. Change your passwords on your computer, e-mail address, and forward your mail to a person you trust;
  7. Do not discuss your plans or case on any social media platform;
  8. Begin a diary. Include everything your spouse does and that you think will be relevant in preparing your case (be specific with dates and times);
  9. If possible, cancel or freeze all joint credit cards (this may be difficult because most credit card companies will require input from your spouse); and
  10. Schedule a consultation with an experienced divorce lawyer.
