FLORIDA PARENTING PLAN

A Florida Parenting Plan is required in all family law matters involving minor children. A Parenting Plan resolves issues regarding primary residential responsibility, parental responsibility, and a time-sharing schedule (visitation).

PRIMARY RESIDENTIAL RESPONSIBILITY IN A FLORIDA PARENTING PLAN

Primary residential responsibility determines which parent will provide the residence where the minor child resides and will spend most of their time. The parent that provides the primary residence is known as the primary residential parent. The primary residential parent will provide for the daily needs of the minor child when the secondary residential parent is not exercising time-sharing.

PARENTAL RESPONSIBILITY

Parental responsibility determines parental input regarding raising the child. Shared parental responsibility (each parent has equal input) will be ordered by the court unless it is determined that shared parental responsibility will not be in the best interests of the child. If the court determines that shared parental responsibility would not be in the best interests of the child, it will order sole parental responsibility. Sole parental responsibility requires the court to determine that shared parental responsibility would be detrimental to the child.

TIME-SHARING (VISITATION)

The secondary residential parent will receive time-sharing with the minor child. The time-sharing schedule should be very specific in identifying regular visitation and holiday visitation. The secondary residential parent will pay child support according to the child support guidelines.
